Town Court

The Town of Albion Court is responsible for adjudicating legal matters within its jurisdiction, including vehicle and traffic violations, small claims, evictions, civil cases, and criminal offenses. The court ensures fair and timely administration of justice for residents and those subject to its proceedings.

What forms of payments are accepted?

  • Cash, Credit Cards, Money Orders or Cashier’s Check.

When and How can Payments be made?

  • They can be made during Court Office Hours or Mailed to Albion Town Court at 3665 Clarendon Rd Albion NY 14411.
  • We also have a Mailbox outside the court building that says Court Clerk. You may drop your payment in there at any time.
  • If you mail a payment or left the payment in the Mailbox, make sure your name and current address is on the payment so we can mail you back the receipt.

How will we know if court is canceled?

  • If there is bad weather and need to cancel court, we will post it on our website and as well on Channel 13 WHAM News.
  • Any other emergencies will be posted on our website to inform you.
  • In case of cancelations, we will send out letters with the new court date.  If you recently moved make sure to update your address with the Court Clerk to ensure you get the information in a timely manner.

What days and time is court?

  • Moore has court on the Second, Third and Fourth Tuesday of the Month at 9:00AM.
  • Fuller has court on the First, Second, Third and Fourth Wednesday of the Month at 10:00AM.
  • No Court on the Fifth Tuesday or Wednesday.
  • Evictions and Small Claims Cases will be called after all Traffic and Criminal Cases on Court Days.

I cannot come to court the day I was scheduled?

  • If you have an attorney, contact your attorney to reach out to the court and the DA’s office to see if an adjournment can, be granted.
  • If you have no attorney and an emergency arises you may call the office to seek an adjournment. They are not automatically approved but you should still reach out to advise the court of your situation.

What if the Defendant does not show up for court?

  • If the defendant fails to appear, a warrant will be issued for his/her arrest and bail money may be forfeited.

Will I receive all my bail money back?

  • All bail money posted is subject to a 3 percent fee authorized by section 99-M of the New York State General Municipal Law.

When can I get my bail money back?

  • Bail money will be returned when the case has been completed.

How do I get my bail money back?

  • Only the person who posted the bail can pick up the bail return from the court.  He/She must have proper identification along with your bail receipt.
  • To avoid an unnecessary trip, be sure to call the court at (585) 589-7048 to make arrangements before arriving at the court to pick up your bail money.

 Can fines be paid from my bail money?

  • Only the person who posted the bail can sign the funds over for the payment of fines. This can be done at the court.

How do I obtain a Certificate of Disposition / Conviction?

In Person

  • Come to the court office during office hours
  • You will be asked to complete a form and provide photo identification.
  • Be sure to include the exact date(s) of arrest and as much information regarding the case as possible.
  • There could be a fee of $5.00 assessed which can be paid in cash, money order and/or cashier’s check.

When do I have to appear for court?

  • Any misdemeanor offense: You must report to court on the date written on the ticket.
  • Any violation offense – You attend court on the date that is written on your ticket.  Or you respond to your ticket by signing either Part A – Guilty OR Part B – Not Guilty.  Mail or drop off your ticket to the court on or before the “return by” date on the ticket.

What happens if I plead guilty?

  • The judge will review your case and assess fines and/or surcharges. A fine letter will be mailed to you. It will include the amount due and due date. Please be sure to give us your correct mailing address and phone number.

What happens if I plead not guilty?

  • You will receive a letter for another court date to speak with the A.D.A regarding your charges.

General Eviction Information:

  • The Court does not provide Eviction Papers – YOU are solely responsible to provide the court with the correct papers.
  • The Court Clerk ONLY provides you with a court date for your eviction to be heard. The Court Clerk WILL NOT and CANNNOT provide any help with filing out the papers or provide legal advice.
  • The fee to file an Eviction is $20.00 which is nonrefundable.
  • The following documents will need to be filed with the Court:
    • Notice of Court Date
    • Eviction Petition
    • Original (5) day late rent notice
    • Original Rent Demand
    • Notice to Recover Real Property
    • Affidavit of Service
  • Once your case is heard, and if judgment is granted, YOU will need to provide the court with the Warrant of Eviction.
  • If a Transcript of Judgment is needed the Court Clerk can provide those 48 hours after the case had been heard. The fee is $2.00 to obtain the Transcript.

  • You need to file in the jurisdiction that holds the address to where the person lives or has a place of business.
  • You need to know the correct spelling of the person’s first and last name or place of business.

(A corporation cannot sue in small claims court but they can be sued by an individual in small claims court.)

  • Once filed a court date will be assigned and papers will be served.

What are the filing fees for a small claims case?

  • $10 for claim of $1,000 or less.
  • $15 for claim of $1,001 to $3,000.

Anything over $3,000 needs to go to the County Clerk’s Office
